Coconut Apps (pty) Ltd is trading as embracelife and will further in these terms and conditions be known as embracelife. Your use of the embracelife.co.za website for research and purchasing of products means that you agree to our Terms and Conditions.  Embracelife may, at its sole discretion, change this agreement or any part thereof at any time without notice. When you place an order for a product online, per e-mail or by telephone you are agreeing to buy it for the price stated, subject to these Terms and Conditions. All new orders are deemed separate and each is treated individually. Please take the time to read the following information carefully:

 

CURRENCY AND PRICING

Prices quoted on embracelife.co.za are in ZAR (South African Rand).

We will always strive to ensure that the prices on our website are accurate but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible, by means of the contact details you provide us with. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full.

 

PRODUCT DISCLAIMER AND INFORMATION ON THE WEBSITE

The product information provided on embracelife.co.za is for educational purposes and is not intended as either diagnosis or treatment of any disease, nor does it replace professional medical advice.

Although embracelife makes every effort to ensure that only the highest quality of the information and advice is published on the website, the contents of the embracelife website, such as text, graphics, and other material (“Content”) located at embracelife.co.za and its subdomains or aliases (“Website”), as well as any links provided to other websites, are for informational purposes only.

You assume full responsibility for how you choose to use this information.

DELIVERY

Embracelife delivers to destinations within the Republic of South Africa only.

Subject to availability and receipt of payment, orders will be processed within one working day. All orders are dispatched via the Post Office or courier.  A delivery being delayed is not ground for return or refund.

You accept that in order for us to prove delivery of an order, we do not have to prove that you personally received the goods, but rather that any person at the delivery address signed for the delivery.

Undelivered packages: If your products are returned to us undelivered, embracelife cannot refund shipping and handling.

 

PRODUCT AVAILABILITY

We will always aim to keep our stock at a good level. However, through unforeseen circumstances, we cannot guarantee that a particular product will always be available. If we are unable to supply a product, we will contact you with options.  If you choose to remove the product from your order rather than wait for availability, you will not be charged for it and we will refund or credit your account with the amount debited by us.

All offers are available while stocks last.

 

RETURNING PRODUCTS

Please check the delivered products as soon as possible on receipt and report it within one working day to embracelife as we will not cover any subsequent loss or destruction.  We will in most cases then make arrangements for a replacement product to be sent to you on our account or to refund you in full for the damaged or broken product.  If we need to evaluate the situation before refunding or replacing the product, we would require of you to return the damaged or broken product to us within 5 working days.  If the goods are then damaged or broken in a way that could be linked to production, storage, packaging, transport or delivery and we agree that it was not damaged after delivery, we will proceed with replacing the product or refunding you in full.  We will also refund you the cost of the return delivery.

Refunds will be made via electronic funds transfer (eft) or directly to the credit card used to place the original order within 30 days or earlier depending on how soon we are given the opportunity to inspect the returned item.

Returns beyond 5 working days: For help with unsatisfactory deliveries later than 5 days after receiving them please email us for more information.

Any other situation related to returning products will be at our discretion.

 

CANCELLATION OF ORDERS

The provision of goods and services by embracelife is subject to availability. In case of unavailability, embracelife will contact you with options.

An order can be cancelled if payment for the order has not yet been made by the customer.  Once payment has been made, the order can only be cancelled before the order has been dispatched by embracelife.

Embracelife may cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled by us, any payment made for the products will be refunded in full.

 

AGREEMENT OF SALE

An agreement of sale between embracelife and a customer is only valid once payment has been made and the company receives proof of payment.  Up until this point all goods remain the property of embracelife.

 

PAYMENT

Payment is accepted by means of Visa, Mastercard, instant eft and electronic funds transfer (eft).  The account details will be provided during the checkout process.  Credit card transactions will be acquired for embracelife via Payfast who use the strictest forms of encryption and top security.

No credit card details are stored on our website.  Credit card details are entered by the customer on the Payfast website for every transaction.

 

PRIVACY

At embracelife we respect your privacy and will take all possible steps to protect your personal information and keep it strictly confidential. No credit card details are stored on our site.  Customer details are used for our purposes only: To process your order(s), to reply to your questions, and provide our newsletter via e-mail (if you have subscribed).  We will not give, sell or rent your personal information or account activity to anyone for any reason.

 

USE OF THE EMBRACE LIFE WEBSITE

The embracelife website may be used by customers to browse content and products and to make purchases.  Persons may not use this site for any purposes such as fraudulent or speculative transactions or to copy, reproduce, republish or redistribute any of the images or content available on the site.

 

LIABILITY

Embracelife will have no liability at all or to pay any money by way of compensation, including without limitation all liability in relation to:
any incorrect or inaccurate information on the embracelife.co.za web site;
any interruptions to or delays in updating the embracelife.co.za web site;
any third party offense caused by their use of embracelife.co.za;
any adverse reaction, loss or damage from the use of a product purchased through the embracelife.co.za website;
any loss or damage resulting from your use or the inability to use the embracelife.co.za website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control;

Embracelife chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature: 97 Mostert Street, Melkbosstrand, 7441, South Africa.
